Toyota Financial Services Vietnam (hereinafter referred to as “TFSVN<\/strong>“) as the Personal Data Controller and\/or Processor, respects the privacy of each individual and complies with all Vietnamese laws on personal data protection, respectfully inform customers, but not limited to individuals who have a contractual relationship with TFSVN, about how TFSVN will process personal data.<\/p>\n

1. Types of Personal Data Collected and Processed<\/strong><\/p>\n

In the context of relationships with individual and corporate customers, service providers, partners, agents, banks, credit institutions, authorities, credit reporting providers, credit information, government agencies, or any third party in connection with any product\/service or customer relationship, TFSVN may collect personal data that is relevant and necessary to fulfill TFSVN\u2019s obligations to provide services and exercise TFSVN\u2019s rights and to improve the customer experience (“Personal Data<\/strong>“). Personal Data may include:<\/p>\n

– Basic Personal Data<\/strong> are data such as full name, middle name and birth name, other names (if any); date of birth; date of death or disappearance; gender; place of birth, place of birth registration, place of permanent residence registration, place of temporary residence registration, current residence, hometown, contact address; nationality; images of individuals; telephone number, personal identification number, passport number, driver’s license number, license plate number; marital status; information about family relationships (parents, children, spouses); information about the individual’s digital account; other information that is associated with a specific person or helps to identify a specific person that is not part of Sensitive Personal Data.<\/p>\n

– Sensitive Personal Data<\/strong> are data such as health status; biometric data, genetic characteristics; data on crimes and law violations collected and stored by law enforcement agencies; the individual’s location is determined through location services; information on usernames to access electronic identification accounts of individuals; images of identity cards, citizen identity cards, identity cards; username of the bank account; bank card information, data on transaction history of bank accounts; financial and credit information and information on activities and history of financial, securities and insurance transactions of customers at credit institutions, foreign bank branches, payment intermediary service providers, securities, insurance, and other licensed organizations; data to monitor behaviors and activities of using telecommunications services, social networks, online communication services and other services in cyberspace; other personal data required by law to be kept confidential or strict security measures required.<\/p>\n

While providing services to customer, TFSVN understand that customer may provide Personal Data of other individuals such as representatives, relatives, guarantors or other third-party individuals to TFSVN. Customer undertakes that, prior to providing such Personal Data to TFSVN, customer has obtained legally valid consent and has issued a legally valid notice to each of the individuals in relation to the collection, transfer and processing of all such data.<\/p>\n

Customer further undertakes that customer will promptly notify TFSVN if any of the above individuals withdraw or modify their consent. The customer shall indemnify and hold TFSVN harmless from all liabilities, damages, disputes, losses and risks arising from the processing of the Personal Data provided by the customer to TFSVN.<\/p>\n

2. Purposes of Processing Personal Data<\/strong><\/p>\n

TFSVN may process customer\u2019s Personal Data in order to exercise TFSVN\u2019s rights and obligations under relevant contracts for the provision of services to customers, improve the user experience, resolve disputes and enforce contractual terms, issue invoices, creating and analyzing statistics, reporting, market research, management, identification, customer communication, marketing, information verification, look up credit information at the National Credit Information Center of Vietnam (CIC) and Vietnam Credit Information Joint Stock Company (PCB), scoring, credit rating and credit information assessment of customers, fraud warnings, credit information fluctuation warnings, searching for borrowers and synthesizing market information, performing lending activities, insurance activities, manage and handle collateral and\/or exercise the rights and obligations of TFSVN in accordance with the law.<\/p>\n

The processing of customer\u2019s Personal Data for the above purposes may include the collection, recording, analysis, validation, storage, editing, publication, combining, accessing, retrieving, retrieving, encrypting, decrypting, copying, sharing, transmission, provision, transfer, delete\/destroy Personal Data.<\/p>\n

3. Processing Methods & Activities<\/strong><\/p>\n

Customer\u2019s Personal Data can be collected through a variety of methods, include but not limited to collecting information through online forms, entering directly into databases, exchanging emails, automated tracking technology, manually collecting paper forms that will then be digitized, or through interactions on TFSVN\u2019s social media platforms or websites and applications or through any other software, tools or devices aligning with applicable laws. Customer\u2019s Personal Data will be stored in an online or offline database owned by TFSVN or a third-party provider.<\/p>\n

The duration of the processing of Personal Data will vary depending on (but will be reasonably consistent with) the normal operation of the processing methods implemented, the type of Personal Data processed and the purpose of the processing and will not exceed the period (if any) prescribed by law. After the retention period, TFSVN may cancel, remove or take any appropriate action in relation to the Personal Data in any reasonable, feasible and appropriate manner that TFSVN understand is permitted by law.<\/p>\n

4. Personal Data Transfer to Third-Party<\/strong><\/p>\n

TFSVN may share customer\u2019s Personal Data to the extent necessary and lawful for the purpose of disclosure, to third parties, whether domestic or foreign, including TFSVN\u2019s group companies, third parties who process the data, TFSVN\u2019s affiliates, agents, government agencies, contractors and\/or subcontractors. In addition, customer\u2019s Personal Data may also be processed remotely by TFSVN or the third parties through systems located outside of Vietnam.<\/p>\n

In the process of performing loan contracts, TFSVN may provide Personal Data of customers to (i) National Credit Information Center of Vietnam (CIC) and (ii) Vietnam Credit Information Joint Stock Company (PCB) for the purpose of creating credit information products, including but not limited to credit scoring, credit information assessment, credit credit rating, fraud warning, credit information fluctuation warning, borrower search and market information synthesis, is carried out by the specialized software of CIC and PCB to provide TFSVN and users in accordance with regulations of the law on the provision of credit information services and other relevant legal provisions. For the purpose of this Personal Data Processing, the customer’s Personal Data is stored and processed for a minimum period of 05 (five) years or another longer period as prescribed by law and in accordance with the purpose of Personal Data Processing.<\/p>\n

Customer\u2019s Personal Data may be shared in connection with the above-mentioned data processing activities, or in the event of a business restructuring or reorganization, or similar activities. In the event that customer\u2019s Personal Data is transferred to a third party, TFSVN are committed to complying with the requirements of applicable Vietnamese law.<\/p>\n

5. Personal Data Protection Measures<\/strong><\/p>\n

TFSVN take the security of the Personal Data provided to TFSVN very seriously. TFSVN are committed to using appropriate technical and organizational measures to protect TFSVN\u2019s customers’ Personal Data from unauthorized access, alteration, disclosure or destruction of data. In addition, TFSVN are also an organization that is strictly regulated by securities regulations in the non-bank credit finance sector, which require TFSVN to have strict policies, procedures (e.g., incident management) and techniques in place to manage risk.<\/p>\n

However, please note that in the course of processing customer\u2019s Personal Data, there may still be security breaches, cyber attacks, unwanted violations of the law by other parties, electronic, computer, technical, systemic errors or damages, etc unexpected servers or other events of a similar nature. Accordingly, customer\u2019s Personal Data may be leaked, lost, deleted, destroyed, stolen, altered, compromised, damaged or otherwise adversely affected. To the extent TFSVN have taken reasonable measures to protect data from these harms, customer agree that TFSVN will not be responsible for any adverse effects on customer\u2019s Personal Data through no fault of TFSVN.<\/p>\n

6. <\/strong>Customer\u2019s Rights<\/strong><\/p>\n

By this notice, TFSVN recognize and guarantee the rights of TFSVN\u2019s customers in relation to their Personal Data (each as defined under applicable regulations), unless otherwise provided for by law:<\/p>\n

– The right to know and confirm the processing of Personal Data relating to customers<\/p>\n

– The right to consent or withdraw consent to the processing of customer\u2019s Personal Data. All activities based on consent will cease for a period of time prescribed by law after the customer withdraws consent.<\/p>\n

– The right to access, amend or request correction of customer\u2019s Personal Data is inaccurate or incomplete within the time limit prescribed by law.<\/p>\n

– The right to request the deletion of Personal Data relating to customers within the time limit and circumstances prescribed by law<\/p>\n

– The right to restrict the processing of customer\u2019s Personal Data<\/p>\n

– Right to object to the processing of customer\u2019s Personal Data<\/p>\n

– The right to complain, denounce and initiate lawsuits against violations of regulations on data protection and claim compensation for damage in accordance with the law<\/p>\n

– The right to request that TFSVN or a competent authority implement safeguards.<\/p>\n

In order to exercise the rights stated above, the customer may send a written request to TFSVN via following contact methods \u00a0for review and support specified below in Section 8.<\/p>\n

In the event that the customer withdraws consent or exercises the rights to erasure, rectification, restriction of processing of Personal Data or other relevant rights in respect of any or all of the customer’s Personal Data by sending a written request to TFSVN, TFSVN may consider and decide not to continue providing TFSVN’s products and services to the customer. The customer’s requests under this provision shall be considered as an act of unilaterally terminating the contract for any credit relationship between the customer and TFSVN, and may completely lead to the breach of the customer’s obligations to TFSVN under the credit contract and relevant agreements concluded. TFSVN reserves the right to take legal remedies in these cases. Accordingly, TFSVN shall not be liable to the customer for any losses incurred and TFSVN’s legal rights shall be expressly reserved for the restriction, suspension, cancellation, or inhibition of the processing of Personal Data at the request of the customer.<\/p>\n

7. Summary of TFSVN’s organizational structure and internal regulations on the Personal Data Protection<\/strong><\/p>\n

TFSVN develops an organizational structure to ensure that the management, processing and protection of Personal Data is carried out uniformly and in compliance with applicable laws. In which<\/p>\n

– CEO<\/strong>: Takes overall responsibility for the Personal Data protection program, approves important decisions, and appoints personnel in charge of data<\/p>\n

– Personal Data Officer (DPO):<\/strong> Compliance consulting, assisting in the implementation of data subjects’ rights, participating in compliance assessments, reporting violations, and acting as a focal point with authorities<\/p>\n

– Personal Data Protection Team (DPT)<\/strong>: Organizing the implementation of policies, procedures, and technical measures; Conduct impact assessments, periodic training, and operate data protection activities<\/p>\n

– Compliance & Legal Department<\/strong>: Providing legal advice and ensuring that data processing activities are in accordance with laws and Group policies<\/p>\n

– Risk Management Department:<\/strong> Monitoring, evaluating and controlling risks related to personal data<\/p>\n

– Other departments<\/strong>: Identify and process data to the right extent, ensure full consent, data security, report violations and comply with TFSVN’s personal data protection policies<\/p>\n

This structure ensures that all Personal Data processing activities at TFSVN are controlled, accountable and transparent.<\/p>\n
